A Canyon County judge sent three new aggravated DUI charges back to magistrate court on Tuesday because of a filing error.
The new charges belong to Nixon Amiclar Ixcoy Lix, the driver accused of killing a local father and injuring three children in a crash. He appeared in district court Tuesday afternoon on a vehicular manslaughter count.
Confusion broke out during the hearing when the state presented the three additional DUI counts. The defense team told the judge they did not know those charges had been filed. The judge took a short recess to review the paperwork.
Upon returning, the judge ruled that the new charges were filed at the wrong court level. The three counts must now go through magistrate court before they can move forward in district court.
A representative for the Canyon County Prosecutor’s Office explained that prosecutors often add charges in DUI cases after reviewing medical records. They add the counts if a victim's injuries meet the specific legal requirements.
Ixcoy Lix will return to court on November 5. That is the next scheduled step before the case proceeds further.
